How Does Centrelink Treat Compensation Payments & Assets

Receiving compensation for lost income due to an injury or traumatic event can be emotionally restorative and provide people with greater financial freedom, however many people may not realise the impact it can have on their Centrelink payments.
Similarly, people who are planning for a new financial period of their lives, such as downsizing in their retirement, may not understand how the sale of their primary residence and purchase of a new primary residence will be treated by Centrelink in the asset test.
In this session, Eloise Cox, Community Lawyer with Social Security Rights Victoria’s Integrated Services Project, have given an overview of compensation preclusion periods, the assets test, income deeming provisions and common challenges people face in these areas.
This session has also addressed the avenues people can pursue when they do not agree with a Centrelink decision – including appeals – and what help is available for clients and community workers (i.e. when and what SSRV can help with).

This session was aimed at small business financial counsellors trained to assist small business owners in company structures. ATO debts are very common feature of small businesses in financial difficulty, and the number of Director Penalty Notices (DPN) being issued by the ATO is significant. This session highlights the risk of personal liability of directors in receipt of a DPN, and the tight timeframe and limited options available for the company and the directors.

Watch out: Scammers!

Scams are a hot topic! the session focussed on developments in the last year, practical ways to support clients who have been scammed, especially how to run an argument with a bank and what you can legitimately expect from these institutions.
The presenters have covered the current legal obligations of banks, especially the meaning of the prudent and diligent banker, identifying red flags in the Scams context. Lucas Rutten has focused on case examples CALC has run, followed by the analysis of some recent useful AFCA Scams cases. A lot of information has been drawn out along with some tips and tricks for supporting clients who are victims of Scams. The session has focused on responding to clients, their rights and responsibilities.
